PURPOSE:

Under the general direction of the Vice President of Student Affairs, the Director provides leadership and direction for the Office of Discrimination, Harassment, and Retaliation Prevention and Title IX Administration. The Director is a hands-on administrator responsible for developing, implementing, monitoring, and coordinating the campus' response to students, faculty, staff, and visitors/third parties experiencing varying degrees of distress. The Director is responsible for university compliance with Title IX of the Education Amendments of the 1972 Civil Rights Act, the Violence Against Women Act Reauthorization of 2012 (VAWA), and CSU system wide and University policies prohibiting discrimination, harassment and retaliation.

ESSENTIAL DUTIES AND RESPONSIBILITIES include, but are not limited to, the following:
  1. Serves as the University's Title IX and Discrimination, Harassment, and Retaliation (DHR) Prevention Administrator, in accordance with CSU Executive Orders 1096 and 1097 (and subsequent iterations when revised), which includes oversight of and/or investigating allegations of discrimination, harassment, retaliation and sexual violence; meeting with the complainant on a regular basis to determine what interim steps are necessary and ensuring that such steps are taken; developing and/or overseeing educational programs and training materials relating to sexual harassment and sexual violence; regularly assessing student activities and campus wide events to ensure that the practices and behaviors do not violate policies against sexual harassment and violence or other discrimination; preparing annual statistical reports in compliance with Chancellor Office mandates; and monitoring and overseeing campus implementation of Title IX and Discrimination compliance. Serves as the University's central resource on issues related to sexual violence, sexual and gender-based harassment, domestic and dating violence, stalking and retaliation ensuring a fair and neutral process for all parties. As part of campus oversight of Title IX/DHR compliance, the Director will participate in the campus Behavioral Intervention Team to ensure real-time information processing.
  2. Oversees investigation of complaints alleging violations of University policies prohibiting discrimination, harassment and retaliation; conducts fact-finding including interviewing the complainant, respondent and potential witnesses, assessing the credibility of witnesses, drawing conclusions, preparing detailed written investigatory reports and making recommendations for action; assesses whether interim remedies are necessary for complainant, pending completion of investigation; uses sound investigative techniques to encourage engagement, interpret policies, analyze situations and logically come to conclusion of preponderance of evidence; engages in dispute resolution on an informal basis; utilizes outstanding organizational skills to ensure well documented, completed files, and documentation; and provides advice and guidance as needed to conclude complaints. Oversees other campus investigators and facilitates the utilization of outside investigators when appropriate.
  3. Coordinates and monitors Title IX efforts of other delegates and university offices that receive and/or investigate complaints, including but not limited to Human Resources, Student Conduct, and Campus Police. Works collaboratively with Human Resources, Academic Personnel, University Corporation Human Resources and the Office of Inclusive Excellence as needed. Implements and recommends relevant campus policies related to areas of responsibility.
  4. Oversees, develops, and provides education, training, and outreach programming to campus community including but not limited to prevention and reporting of sexual violence, sexual and gender-based harassment, domestic and dating violence, stalking and retaliation; conducts outreach and awareness activities regarding students of concern. Presents educational programs on nondiscrimination and harassment prevention and assures campus compliance with AB 1825. Monitors and oversees campus implementation of the California Whistleblower Act. Provides or recommends training to Deputy Title IX Coordinators, responsible employees, investigators, and other campus officials with Title IX responsibilities.
  5. In partnership with Human Resources and Office of Inclusive Excellence and Sustainability, develops and provides education, training, and programming for campus efforts related to diversity and inclusion as appropriate, as well as managerial training to help retention and discrimination prevention efforts. The Director will coordinate with Human Resources, the Office of Inclusive Excellence and Sustainability, and Otter Cross Cultural Center as appropriate to create, partner, and/or support these efforts.
  6. Oversees Equal Employment Opportunity (EEO) reviews for active recruitments, as well as day-to-day management of any campus Equity Advocates. The Director is responsible for coordinating and partnering with Human Resources to ensure Equity Advocate training and onboarding is implemented effectively. All EEO work shall be conducted with the strictest confidence, with no sharing of information related to specific recruitment information outside of Human Resources and established protocols.
  7. Hires, trains, evaluates, and supervises staff. Develops and manages office operations and budget.
  8. Keeps current with frequent changes in system-wide policies and federal and state policy changes that affect the scope of responsibilities. Serves on committees, task forces, and advisory boards, programs and projects as assigned.

MINIMUM QUALIFICATIONS:

A master's degree in social work, psychology, higher education administration or related field from an accredited university. Minimum of five years of progressively responsible supervisory or management experience, preferably in a large public or private organization or institution of higher education, with responsibility for compliance with laws, regulations and guidelines in a comprehensive employment practices and/or affirmative action program.

PREFERRED QUALIFICATIONS:

Juris Doctorate strongly preferred; significant experience conducting investigations of complaints either alleging discrimination, harassment or sexual violence, including interviewing witnesses, making credibility assessments, drawing conclusions and preparing detailed, written reports.

Technical fluency with Oracle/PeopleSoft, CSU Common Management System or equivalent student information system; Microsoft Office Professional Suite, and Google mail and calendaring programs.

          Significant experience conducting investigations of complaints either alleging discrimination, harassment or sexual violence, to include interviewing parties, making credibility assessments, drawing conclusions, and preparing detailed written reports.

          MINIMUM QUALIFICATIONS:

          A master's degree in social work, psychology, higher education administration or related field from an accredited university. Minimum of five years of progressively responsible supervisory or management experience, preferably in a large public or private organization or institution of higher education, with responsibility for compliance with laws, regulations and guidelines in a comprehensive employment practices and/or affirmative action program.

          PREFERRED QUALIFICATIONS:

          Juris Doctorate strongly preferred; significant experience conducting investigations of complaints either alleging discrimination, harassment or sexual violence, including interviewing witnesses, making credibility assessments, drawing conclusions and preparing detailed, written reports.

          Technical fluency with Oracle/PeopleSoft, CSU Common Management System or equivalent student information system; Microsoft Office Professional Suite, and Google mail and calendaring programs.

          • May require occasional evenings and/or weekend work.

          PHYSICAL ENVIRONMENT:

          Office environment with standard equipment and tasks. The position requires working at a computer and desk for extended periods of time. May require travel between campus offices and off-campus locations.
